- Death Penalty Aggravator Dropped from Bill
HB 1153, a bill concerning
changes to Colorado's sex offender laws,
was introduced in January. One provision
of the bill would have made "being a sexually
violent predator at the time of committing
a capital offense" a
death penalty aggravator. This portion
of the bill was removed by the House Judiciary
Committee, thanks, in part, to the hard
work and testimony of several people from
the Public Defender's office. With that
and other changes, the amended bill was
passed out of committee February 2 on a
10-1 vote and sent to the Colorado General
Assembly for further consideration. (3/30/06,

Considers Death Penalty for Violent Sex Offenders
DENVER -- State lawmakers are
considering a plan that would make someone
convicted of murder eligible for the death
penalty if they have a sexually violent past, along with a host of proposed
laws to track down and punish sex offenders. The death penalty measure
is one of six bills that will be considered this week at the Legislature
to correct what lawmakers call oversights in state law. ... Sen. Shawn
Mitchell, R-Broomfield, said it was a major oversight by lawmakers not
to include sexually violent crimes on the list of aggravators warranting
the death penalty. ... Rep. Gwen Green, D-Golden, said she may have
a hard time voting for the death penalty for sexually violent predators
who commit a capital crime. Green has a bill that would clarify the
Department of Justice is responsible for screening sex offenders to
