Colorados Death Row -- 9/99
Nathan Dunlap was sentenced to death for killing four people at a pizza restaurant in Aurora. The Colorado Supreme Court recently affirmed Mr. Dunlaps conviction and death sentence in his direct appeal. A Petition for Writ of Certiorari has been filed in the United States Supreme Court. If it is denied, Mr. Dunlap will then seek state postconviction relief.
Robert Harlan was convicted of kidnapping, sexually assaulting and killing a woman in Adams County. He is represented in his direct appeal by Kathleen Lord, Chief Appellate Deputy in the state public defenders office. She presented oral argument to the state supreme court on September 29, 1998. As of the last week of September 1999, the Colorado Supreme Court has not yet released its decision, but could do so at any time.
Francisco Martinez was convicted in Jefferson County of killing a 14-year-old girl. A three-judge panel sentenced him to death on May 27, 1999. Mr. Martinez is beginning the appellate process, and is represented in his direct appeal to the Colorado Supreme Court by Seth Benezra, Jean Dubofsky and Dean Neuwirth.
Cody Neal was sentenced to death on September 29, 1999 in Jefferson County.
Frank Rodriguez was sentenced to death for killing a Denver bookkeeper in 1984. Mr. Rodriguez has been through the state appeals and postconviction process, and a federal district judge recently denied his habeas corpus petition. The case is now on appeal in the United States Court of Appeals for the Tenth Circuit. His lawyers, David Lane and David Lindsey, report that the opening brief is due in mid-April with oral arguments expected to take place in October 2000.
